Pentagon may take legal action against SEAL author

(AP) ? The Pentagon's top lawyer has informed the former Navy SEAL who wrote a forthcoming book describing details of the raid that killed Osama bin Laden that he violated agreements to not divulge military secrets and that as a result the Pentagon is considering taking legal action against him.

The general counsel of the Defense Department, Jeh Johnson, wrote in a letter transmitted Thursday to the author that he had signed two nondisclosure agreements with the Navy in 2007 that obliged him to "never divulge" classified information.

"This commitment remains in force even after you left the active duty Navy," Johnson wrote. He said the author, Matt Bissonnette, left active duty "on or about April 20, 2012," which was nearly one year after the May 2011 raid.

By signing the agreements, Bissonnette acknowledged his awareness, Johnson wrote, that "disclosure of classified information constitutes a violation of federal criminal law." He said it also obliged the author to submit his manuscript for a security review by the government before it was published. The Pentagon has said the manuscript was not submitted for review, although it obtained a copy last week.

Johnson said that after reviewing a copy of the book, "No Easy Day," the Pentagon concluded that the author is in "material breach and violation" of the agreements.

The book is to be published next week by Penguin Group (USA)'s Dutton imprint. The Associated Press purchased a copy Tuesday.

Johnson addressed his letter to Mr. "Mark Owen," using quotation marks to signify that that this is the author's pseudonym. His real name is Matt Bissonnette.

Bissonnette referred requests for comment about the letter to his publisher, which was not immediately available.

"I write to formally advise you of your material breach and violation of your agreements, and to inform you that the department is considering pursuing against you, and all those acting in concert with you, all remedies legally available to us in light of this situation," Johnson wrote.

The Pentagon has not revealed how it got a copy of the book.

Johnson noted that "copies of the book have apparently already been released." He added, "further public dissemination of your book will aggravate your breach and violation of your agreements."

The Pentagon did not release copies of the nondisclosure agreements that it said Bissonnette had signed in 2007. A spokesman, Army Col. Steve Warren, said they were being withheld because they include the author's real name and his signature.

In his book, Bissonnette wrote that the SEALs spotted bin Laden at the top of a darkened hallway and shot him in the head even though they could not tell whether he was armed. Administration officials have described the SEALs shooting bin Laden only after he ducked back into a bedroom because they assumed he might be reaching for a weapon.

Military experts said Wednesday that if Bissonnette's recollection is accurate, the SEALS made the right call to open fire on the terrorist mastermind, who had plenty of time to reach for a weapon or explosives as they made their way up to the third level of the house where he hid.

Early menopause: A genetic mouse model of human primary ovarian insufficiency

ScienceDaily (Aug. 30, 2012) ? Scientists have established a genetic mouse model for primary ovarian insufficiency (POI), a human condition in which women experience irregular menstrual cycles and reduced fertility, and early exposure to estrogen deficiency.

POI affects approximately one in a hundred women. In most cases of primary ovarian insufficiency, the cause is mysterious, although genetics is known to play a causative role. There are no treatments designed to help preserve fertility. Some women with POI retain some ovarian function and a fraction (5-10 percent) have children after receiving the diagnosis.

Having a mouse model could accelerate research on the causes and mechanisms of POI, and could eventually lead to treatments, says Peng Jin, PhD, associate professor of human genetics at Emory University School of Medicine.

The results were published online recently in the journal Human Molecular Genetics.

The paper was the result of a collaboration between researchers at Emory and the Institute of Zoology, Chinese Academy of Sciences in Beijing. Dahua Chen, PhD, associate director of the State Key Laboratory of Reproductive Biology, is the senior author and postdoctoral fellow Cuiling Lu is the first author. Stephanie Sherman, PhD, professor of human genetics at Emory, is a co-author.

The mouse model builds on research on women who are carriers of a "premutation" for fragile X syndrome, a leading cause of inherited intellectual disability. The mice have a fragment of a human X chromosome from a fragile X premutation carrier. Other non-genetic mouse models used to study menopause include surgical removal of the ovaries, or exposure of mice to a chemical, 4-vinylcyclohexene diepoxide, which depletes the ovaries.

"While the fragile X premutation is a leading cause of POI, I think this model will be useful and relevant for all women with this condition," Jin says.

Women with the fragile X premutation account for around two percent of spontaneous POI cases and 14 percent of familial POI cases. About 20 percent of women who carry the fragile X premutation experience POI, the disorder now called fragile X-associated POI, or FXPOI.

Fragile X syndrome is caused by the expansion of a "triplet repeat" in a gene (FMR1) that is important for signaling in the brain. In fragile X syndrome, the triplet repeat -- three DNA letters (CGG) repeated many times -- forces the gene to shut off.

For a woman who carries the premutation, the triplet repeat is not large enough to shut the gene off. There is a risk that it will expand in her children enough to generate fragile X syndrome. In addition, the triplet repeat appears to have an effect on the woman's ovaries, independently from its influence on the FMR1 gene. Jin says studying mice that have an analogous genetic alteration will help scientists understand what's happening to the ovaries in POI. It appears that the RNA coming from the premutation impairs development of the ovarian follicles, the structures in which eggs/oocytes mature.

The research team found that a quarter of premutation-carrying female mice are infertile. When they are housed with male mice, those that do have pups have them a month later on average (12.5 weeks of age compared to 8.5 weeks), and they have fewer pups.

Puberty occurs at roughly five weeks of age in mice, and the premutation mice have alterations in their ovaries already before puberty. At 25 days of age, there are a reduced number of mature follicles in ovaries of the female mice carrying the premutation. Those mice also have altered levels of hormones resembling those of women with POI, such as elevated FSH (follicle stimulating hormone).

The research team found that in the ovaries of mice with the fragile X premutation, ovulation-related genes are less active. In addition, two cellular signaling pathways (Akt/mTOR) are less active in the ovaries, suggesting that drugs that affect those pathways could be used to treat POI.

The research in Jin's laboratory was supported by the National Institute of Neurological Disorders and Stroke (NS051630 and NS067461). Chen's laboratory is supported by the Chinese Academy of Sciences, the National Basic Research Program of China and the National Science Foundation of China.

Black camerawoman in GOP incident: 'Not surprised'

The CNN camerawoman who was reportedly the victim of racially-motivated taunting on the floor of the Republican National Convention is speaking out about her ordeal.

?I hate that it happened, but I?m not surprised at all,? Patricia Carroll, 34, told Maynard Institute blogger Richard Prince. Prince?s blog addresses issues of racial diversity in journalism.

?This situation could happen to me at the Democratic convention or standing on the street corner,? she added. ?Racism is a global issue.?

According to reports, Carroll was pelted with peanuts by a couple GOP convention attendees while covering the proceedings. She was allegedly told, ?This is how we feed animals.?

CNN acknowledged that an incident took place and the RNC removed the two individuals who were allegedly responsible.

?Two attendees tonight exhibited deplorable behavior,? convention spokesman Kyle Downey told The Hill. ?Their conduct was inexcusable and unacceptable. This kind of behavior will not be tolerated.?

For her part, Carroll, who is a 34-year-old Alabama native, says this kind of behavior is often spurred by a lack of diversity.

?This is Florida, and I?m from the Deep South,? said Carroll. ?You come to places like this, you can count the black people on your hand. They see us doing things they don?t think I should do.?

She then pointed out that ?there are not many black women? at the RNC.

?I can?t change these people?s hearts and minds,? Carroll added. ?No, it doesn?t feel good. But I know who I am. I?m a proud black woman. A lot of black people are upset. This should be a wake-up call to black people?. People were living in euphoria for a while. People think we?ve gone further than we have.?

Protein linked to increased risk of heart failure and death in older adults

ScienceDaily (Aug. 29, 2012) ? A protein known as galectin-3 can identify people at higher risk of heart failure, according to new research supported by the National Heart, Lung, and Blood Institute (NHLBI), part of the National Institutes of Health. This research is based on work from the NHLBI's Framingham Heart Study, which began in 1948 and has been the leading source of research findings about heart disease risk factors.

Heart failure occurs when the heart cannot fill with enough blood and/or pump enough blood to meet the body's needs. Galactin-3 has recently been associated with cardiac fibrosis, a condition in which scar tissue replaces heart muscle, and cardiac fibrosis plays an important role in the development of heart failure.

Heart failure carries enormous risk for death or a lifetime of disability and often there are few warning signs of impending heart failure. Measuring levels of galectin-3 in the blood may offer a way to identify high-risk individuals who could benefit from treatments to prevent debilitating heart failure and death. Early identification of predisposed individuals would allow treatment to begin long before heart failure develops and could help people at high risk for heart failure to live longer, more active lives.

Galectin-3 levels were measured in 1996-1998 as part of a routine examination of 3,353 participants enrolled in the Offspring Cohort of the Framingham Heart Study. At the time of measurement the average age of the participants was 59 years old. During an average follow-up of 11 years, 166 participants (5.1 percent) had a first heart failure event. Among the 25 percent of people with the highest galectin-3 levels (ranging from 15.4 to 52.1 nanograms per milliliter) the annual rate of heart failure was 12 per 1,000 people compared with 3 per 1,000 people for the 25 percent of participants with the lowest galectin-3 levels (ranging from 3.9 to 12 nanograms per milliliter). Fifty-three percent of participants were women.

Spironolactone and other related drugs believed to counteract cardiac fibrosis have been shown to improve outcomes in heart failure patients. Future research will be needed to determine whether treatment with these or other drugs can benefit healthy patients with elevated galectin-3 levels.

PHILADELPHIA (CBS) ? They?re partners in crime.? No, not Bonnie and Clyde or Thelma and Louise or Butch and Sundance, but Robot and Frank.

The caretaker robot may get first billing, but it?s the elderly thief who?s the moving main attraction in this abundantly warm and ingratiating but never syrupy caper movie that?s as light-fingered as its protagonist.

Robot & Frankis a science fiction comedy-drama/buddy caper flick set in the near future that might just steal your heart.

Frank Langella stars as Frank, a lonely, crusty, aging former cat burglar and convict who lives in upstate New York, where he struggles with senility.? His memory during this early stage of dementia is just about totally unreliable, and yet in some ways he remains as sharp as a tack.

He shoplifts on occasion, mostly out of boredom, and flirts with the fetching town librarian ? (remember libraries? remember books?) ? played by Susan Sarandon, whose place of employment is about to be digitally replaced.

James Marsden plays his son, Hunter, a married Princeton grad, who resents the absentee father that Frank was when he was in prison but looks in on him regularly anyway.? Liv Tyler plays Frank?s daughter, Madison, who is busy traveling around the world.

Yep, his kids are a yuppie and a hippie.

Worried about his dad?s declining faculties but not wanting to put him in a home, Hunter buys Frank a surprise gift, a domestic robot, voiced by Peter Sarsgaard, that?s been programmed as a health care aide, devoted to improving Frank?s mental and physical health.

The remarkable droid is here to watch over Frank, to cook his meals and clean his house and be his calendar and keep him company.

And, it turns out, once Frank?s initial reluctance turns into gratefulness, to become his only friend -? even though Frank refrains from renaming it and continues to use the generic label.

And Robot is his colleague as well, because Frank programs it to help him with the elaborate heist he?s planning by picking locks and cracking safes.? And as accomplices go, Robot is a quick learner.

This return to a life of crime -? Frank?s comfort zone ? seems to be rejuvenating him in various ways as his human intelligence teams up with his odd-couple partner?s artificial intelligence to pull off their unlawful undertaking.

Impressive first-time director Jake Schreier concocts a well-judged portrait of our near future with barely a smidgen in the way of special effects (recall Woody Allen?s Sleeper to picture the minimalist level of science-fiction fuss) and he works from a thoroughly original screenplay by Christopher D. Ford that also includes a whopper of a niftily embedded twist that you are hereby defied to see coming.

Langella, Oscar-nominated as best actor for Frost/Nixon, excels once again, playing the Alzheimer?s-burdened title character with a subtle mix of whimsicality and melancholy, as well as impatience and disgust with his own decrepitude. He?s slyly and subtly funny, is in virtually every scene, and never makes a false move.

And best actress Oscar winner Sarandon (Dead Man Walking) brings her radiant glow to the proceedings even if she is playing a quiet, bespectacled librarian.

But the teaming that most intrigues here is that of Frank and Jake, the veteran watchable star and his rookie director to watch, as the end of one impressive career intersects with what would appear to be the beginning of another in the kind of movie that makes us look forward to any project either of them gets involved in.

So we?ll burgle 3 stars out of 4 for the sweetly stylish charmer, Robot & Frank, which looks in on the world?s technological near future while sneaking a peek at the near future waiting for each of us: old age.

Cat videos get their moment at Minn. film festival

MINNEAPOLIS (AP) ? Warning: This is a story about online cat videos. If you're among the seemingly tiny minority of the general population not interested in watching a 1-minute clip of a cat in a T-shirt pounding on a keyboard, then move along.

For everyone else, a new measure of respectability is looming for an Internet pleasure that is both massively popular and, for some people, a bit embarrassing. The Walker Art Center, a well-regarded museum of modern art in Minneapolis, on Thursday is presenting its first "Internet Cat Video Film Festival" to showcase the best in filmed feline hijinks.

With about 70 videos over 60 minutes, the Walker is mounting a social experiment as much as a film festival. At issue is whether cat video lovers used to gorging on the clips in the privacy of their homes will do so in public ? an online community of fellow aficionados interacting face to face for the first time.

"It is a cultural phenomenon that raises some interesting questions," said Katie Hill, the Walker program associate who first suggested the festival.

But Hill, a self-described "art historian and cat lady," was quick to add: "I'm not a behavioral psychologist, I'm not a sociologist. I just think they're funny and cute, and I think a lot of other people do too."

The numbers bear it out. Some of the classics of the form have racked up tens of millions of YouTube page views. The aforementioned "Keyboard Cat" posted 26.3 million page views since it was posted in 2007. A 30-second clip titled "Very Angry Cat" ? can you guess the plot? ? has 78.5 million page views since 2006.

"Some you just watch over and over and over again," said Angie Bailey, a cat blogger and owner from Chisago City, Minn., covering the film festival for the website Catster.com. "When you want to laugh and feel good it's sort of an escape from what happens in the real world."

Walker programmers got about 10,000 submissions for the festival after initially expecting several hundred. They whittled that down to the 70 videos to be shown on an outdoor screen on the museum's grounds.

Afterward, festivalgoers will be able to vote online for a "Best in Show" award. In addition, the Walker programmers picked a "Golden Kitty Award" to be bestowed at the end of the night.

"The Walker has advised, if you bring your cat put it on a leash," said Josh Feist, a Minneapolis arts administrator who planned to take his cat, Pickles, to the show. "It could be potentially crazy if there are hundreds of people who bring their cats. It will be interesting to see what develops."

NEW YORK (AP) ? The phone calls went out from Saigon's Xa-Loi Buddhist pagoda to chosen members of the foreign news corps. The message: Be at a certain location tomorrow for a "very important" happening.

The next morning, June 11, 1963, an elderly monk named Thich Quang Duc, clad in a brown robe and sandals, assumed the lotus position on a cushion in a blocked-off street intersection. Aides drenched him with aviation fuel, and the monk calmly lit a match and set himself ablaze.

Of the foreign journalists who had been alerted to the shocking political protest against South Vietnam's U.S.-supported government, only one, Malcolm Browne of The Associated Press, showed up.

The photos he took appeared on front pages around the globe and sent shudders all the way to the White House, prompting President John F. Kennedy to order a re-evaluation of his administration's Vietnam policy.

"We have to do something about that regime," Kennedy told Henry Cabot Lodge, who was about to become U.S. ambassador to Saigon.

Browne, who died Monday at a New Hampshire hospital at age 81, recalled in a 1998 interview that that was the beginning of the rebellion, which led to U.S.-backed South Vietnamese President Ngo Dinh Diem being overthrown and murdered, along with his brother, Ngo Dinh Nhu, the national security chief.

"Almost immediately, huge demonstrations began to develop that were no longer limited to just the Buddhist clergy, but began to attract huge numbers of ordinary Saigon residents," Browne said in the interview.

Browne was diagnosed with Parkinson's disease in 2000 and spent his last years using a wheelchair to get around. He was rushed to the hospital Monday night after experiencing difficulty breathing, said his wife, Le Lieu Browne, who lives in Thetford, Vt.

Browne spent most of his journalism career at The New York Times, where he put in 30 years of his four decades as a journalist, much of it in war zones.

By his own account, Browne survived being shot down three times in combat aircraft, was expelled from half a dozen countries and was put on a "death list" in Saigon.

In 1964, Browne, then an AP correspondent, and rival Times journalist David Halberstam both won Pulitzer Prizes for their reporting on the conflict in Vietnam. The war had escalated because of the Nov. 1, 1963, coup d'etat in which Diem was killed.

The plot ? by a cabal of generals acting with tacit U.S. approval ? was triggered in part by earlier Buddhist protests against the pro-Catholic Diem regime. These drew worldwide attention when the monk set himself afire in protest as about 500 people watched.

The burning monk photo became one of the first iconic news photos of the Vietnam War.

"Malcolm Browne was a precise and determined journalist who helped set the standard for rigorous reporting in the early days of the Vietnam War," said Kathleen Carroll, AP executive editor and senior vice president. "He was also a genuinely decent and classy man."

Hal Buell, who was a deputy photo editor in New York City when the photo of the burning monk was taken, said, "That picture put the Vietnam War on the front page more than anything else that happened before that. That's where the story stayed for the next 10 years or more."

Malcolm Wilde Browne was born in New York on April 17, 1931. He graduated from Swarthmore College in Pennsylvania with a degree in chemistry. Working in a lab when drafted in 1956, he was sent to Korea as a tank driver, but by chance got a job writing for a military newspaper, and from that came a decision to trade science for a career in journalism.

He worked first for the Middletown Daily Record in New York, where he worked alongside Hunter S. Thompson, author of "Fear and Loathing in Las Vegas." Browne then worked briefly for International News Service and United Press, the forerunner of United Press International, before joining the AP in 1960. A year later, the AP sent him from Baltimore to Saigon to head its expanding bureau.

There, he became a charter member of a small group of reporters covering South Vietnam's U.S.-backed military struggle against the Viet Cong, a home-grown communist insurgency.

Within the year he was joined in Saigon by photographer Horst Faas and reporter Peter Arnett. By 1966, all three members of what a competitor called the AP's "human wave" had earned Pulitzer Prizes ? one of journalism's highest honors ? for Vietnam coverage.

Writing about official corruption and military incompetence, the group ? which also included the Times' Halberstam, Neil Sheehan of UPI, Charles Mohr of Time magazine, Nick Turner of Reuters and others ? were accused by critics in Vietnam and Washington of aiding the communist cause.

At one news briefing, Browne's persistent questions prompted an exasperated U.S. officer to ask, "Browne, why don't you get on the team?"

Browne, like some of his peers, initially saw the U.S. commitment to helping the beleaguered Saigon government as a reasonable idea.

In his 1993 memoir, "Muddy Boots and Red Socks," Browne said he "did not go to Vietnam harboring any opposition to America's role in the Vietnamese civil war" but became disillusioned by the Kennedy administration's secretive "shadow war" concealing the extent of U.S. involvement.

Amid the furor over tendentious coverage, some reporters claimed to have received death threats, and Browne said his name was among those on a list of "supposed enemies of (South Vietnam) who had to be eliminated."

In the 1998 interview, he said that he "never took that seriously" but that when South Vietnam government agents tried to arrest his wife, who had angered officials by quitting her information ministry job, Browne stared them down by standing in his doorway brandishing a souvenir submachine gun.

Tall, lanky and blond, Browne was a cerebral and eccentric character with a penchant for red socks ? they were easy to match, he explained ? and an acerbic wit befitting his grandfather's cousin, Oscar Wilde.

He ridiculed the word "media," for example, as "that dreadful Latin plural our detractors use when they really mean "scum."

Overall, associates saw him as complex, rather mysterious, and above all, independent.

"Mal Browne was a loner; he worked alone, did not share his sources and didn't often mix socially with the press group," recalled Faas, who died this year. "And stubborn ? he wouldn't compromise on a story just to please his editors or anyone else."

Browne wrote a 1965 book, "The New Face of War," and a manual for new reporters in Vietnam. Among its kernels of advice: Have a sturdy pair of boots, watch out for police spies who eavesdrop on reporters' bar conversations, and "if you're crawling through grass with the troops and you hear gunfire, don't stick your head up to see where it's coming from, as you will be the next target."

South Vietnamese officials censored early news reports but to mixed effects. At least once, Browne sent a story to the AP by surreptitiously taping a handwritten note over an innocuous photo being transmitted to Tokyo.

By 1965, impressed by how television appeared to be dominating the public discourse, the reporter who had never owned a TV set left the AP to join ABC News in Vietnam.

Browne quit ABC after a year over management questions.

After a venture into magazine writing, Browne joined The New York Times in 1968. He worked in Latin America, Eastern Europe and Asia, left again to edit a science magazine, and returned to the Times in 1985, mainly as a science writer. He also covered the 1991 Gulf War, again clashing with U.S. officials over censorship issues.

Earlier this month, on Aug. 11, Browne, sporting his trademark red socks, spoke in New York City at a memorial reception honoring his Saigon compatriots Faas and George Esper, who also died this year. He referred to the gathering as "a family reunion," saying he "always regarded the AP as his second family."

In addition to his wife, survivors include a son, Timothy; a daughter, Wendy, from a previous marriage; a brother, Timothy; and a sister, Miriam.

Browne will be buried on the family's property in Vermont, his widow said.

Fuera de Serie, a Spanish magazine, has sparked controversy with its new cover depicting Michelle Obama as a 19th Century French slave. Seriously.

The First Lady of the United States' face is superimposed over "Portrait d'une négresse," a famous painting by French artist Marie-Guillemine Benoist.

The painting from 1800 depicted a female French slave in a headdress and white gown, one breast exposed. Now Michelle Obama is shown as such:

The painting was finished just six years after France's abolition of slavery and has been regarded by art historians as a commentary on both sexism and racism.

Not surprisingly, the image has many critics in the U.S. and Europe wondering if the cover was designed to be more provocative than political ... ya think?!

For its part, the magazine lauds Michelle Obama as the "gran mujer" (great woman) behind her powerful husband. An excerpt of the cover story reads:

"In the shadow of the U.S. President is a person whose popularity ratings exceed those of Barack’s own. This person is none other than his wife Michelle."

"To find out how Michelle has managed to seduce the American people, [we] detail the secrets of a woman who has won [America's hearts]."

Many believe it smacks of racism and reinforces the historical denial of black female individuality, but artist Karine Percheron-Daniels stands by it.

In fact, she thinks Michelle would "love" the picture and would love to show it to Mrs. Obama one day. We wouldn't hold our breath if we were Karine.

Senegal appeals to Gambia to halt executions

DAKAR (Reuters) - Senegalese President Macky Sall joined international appeals for neighboring Gambia to halt a series of planned executions of death row prisoners, confirming on Tuesday that two of the nine who have already faced the firing squad were Senegalese.

The executions, more of which are planned in coming weeks, have the potential to upset delicate ties between the two poor West African neighbors just as Sall wants Gambian cooperation to end the separatist conflict in Senegal's Casamance region.

Gambian President Yahya Jammeh vowed this month to execute all of 40-plus death row inmates by mid-September "to ensure that criminals get what they deserve", drawing condemnation from the African Union, the European Union, Britain, Germany, France and human rights groups.

"Macky Sall calls for an urgent stay of execution for all the cases," a statement issued by his office said after Gambia on Monday confirmed it had executed six civilians and three members of the army for a variety of crimes which it said all involved murder.

Sall said two of those executed were Senegalese and that a third national was still facing the firing squad.

Rights group Amnesty International, said in a statement that the 38 people still on death row faced imminent risk of execution, adding that there were concerns most of them were convicted after unfair trials.

"Some were sentenced after being tried on politically motivated charges and have been subjected to torture and other ill-treatment to force confessions," Paule Rigaud, Amnesty International's Deputy Director for Africa, said.

U.N. Special Rapporteur on arbitrary executions, Christof Heyns, said the executions were a step backward for the West African nation, which has had a 27-year moratorium on the death penalty and abolished capital punishment for drug offences in April 2011.

Heyns also raised concern over the trials and the execution of the sentences.

"According to available evidence the trials did not meet due process safeguards," Heyns said in a statement.

"The executions were carried out in secrecy, away from the public and from the families, and do not meet the requirements of transparency," he said.

Jammeh, who seized power in a 1994 coup, has long faced criticism over his rights record in a country that attracts British sun-seekers with its tropical climate and white beaches.

In common with a number of African states, Gambia has the death penalty but until now has rarely used it. British rights group Amnesty said the last execution there was in 1985.

It is unclear why Jammeh, who won re-election last year in a poll that regional groups said had been marked by intimidation of voters and opponents, is pressing ahead with executions now.

One of Africa's most controversial rulers, Jammeh announced in 2007 that he had a herbal concoction that cured AIDS, but only on Thursdays, a statement derided by health experts.

Senegal's Sall, who saw off incumbent Abdoulaye Wade in a March presidential election, has sought to enlist Gambian cooperation to end a low-intensity separatist rebellion in the Casamance region that skirts Senegal's neighbor.

The insecurity in the region has forced thousands from their homes and killed off most of the once-thriving tourist sector in Casamance that once brought millions of dollars into the Senegalese public purse.

Colombia's president: talks held with FARC rebels

BOGOTA, Colombia (AP) ? President Juan Manuel Santos said Monday that his government has opened "exploratory talks" with Colombia's main rebel groups in a bid to end a stubborn half-century-old conflict.

Santos' announcement in a brief televised address followed mounting rumors of talks supposedly held in Cuba between representatives of his government and the leftist Revolutionary Armed Forces of Colombia.

Santos offered no details of the talks, including when they began.

"In the coming days the results of the conversations with the FARC will become known," he said.

Santos said military operations would continue "on every single centimeter of national territory" during whatever peace process might emerge.

That statement was a clear allusion to the last peace dialogue held with the FARC, when the government surrendered a Switzerland-sized swath of southern Colombia to the rebels from 1990-2002 and reconciliation efforts collapsed as the guerrillas continued to mount attacks on security forces, kidnap politicians and traffic in cocaine.

Santos also mentioned that Colombia's No. 2 rebel band, the National Liberation Army known by its Spanish-language initials ELN had expressed a desire to participate in peace talks.

The ELN has also held failed peace talks with the government in the past.

Panda preferences influence trees used for scent marking

ScienceDaily (Aug. 27, 2012) ? As solitary animals, giant pandas have developed a number of ways to communicate those times when they are ready to come into close contact. One means of this communication occurs through scent marking. A recent study by San Diego Zoo Global researchers, collaborating with researchers at the Institute of Zoology, Chinese Academy of Science, indicates that pandas make clear and specific choices about what trees are used for scent marking.

"Variables affecting the selection of scent-marking sites included bark roughnesss, presence of moss on the tree trunk, tree diameter and distance to the trail," said Ron Swaisgood, Ph.D., co-head of San Diego Zoo Global's Giant Panda Conservation Unit.

"These choices have clear effects on the scent signal, making it last longer, be detected from further away, or otherwise enhance its communication efficiency. We are not surprised that pandas are efficient with their use of chemo-signals, as mounting evidence suggests that many aspects of giant panda life history are constrained by their energetically poor diet."

This study, which was recently published in Animal Behavior, confirms that old-growth forest and other factors like tree type are important for maintaining habitat that will support giant panda conservation.

If news of the sudden demise of Canadian husband-wife, synth-punk duo Handsome Furs wasn?t shocking enough, Dan Boeckner?s subsequent announcement caught most indie-rock fans off-guard earlier this year.
The lanky singer/guitarist, also formerly of Wolf Parade, decided to merge with two of his friends to create a new group ? Divine Fits.
Not just any old friends, mind you. Indie-rock royalty Britt Daniel, frontman of Spoon, contributes vocals, guitars and some of the band?s songs, while punk drummer Sam Brown, of New Bomb Turks, keeps time.
?I just wanted to be in a band where I didn?t write all of the songs and didn?t sing all of the songs, but I still wanted to write some of the songs and sing some of the songs,? Daniel tells austin360.com, a website from his Texas hometown.
He ended up writing four tracks on A Thing Called Divine Fits, while Boeckner wrote four, starting with the opener, ?My Love Is Real,? an icy, jittery synth-pop tune which sounds like it should be on a Handsome Furs album.
That?s the problem with A Thing Called Divine Fits ? Boeckner, Daniel and Brown rarely ever feel like they?re creating new sounds or challenging themselves as songwriters and musicians.
Daniel?s songs might feel a bit faster and synthier than usual, but that?s not enough to set them apart from his previous output. In fact, if you heard ?Flaggin? A Ride,? with its antsy riffs and jerky rhythms, or ?Like Ice Cream,? a rootsy, groovy number, you?d be tempted to think they were new Spoon tunes.
If you don?t care how or under what name Daniel or Boeckner release their songs, then you?ll probably think this 11-song debut is divine. If you want more than just a rehash, then you?ll be happy to hear two of your favourite bands/frontmen on one album, but disappointed with their lack of sonic explorations.
Then again, maybe some of us expect too much. Maybe it?s not so easy for the three to come with something entirely free of their past. Their one collaboration as a trio, ?Would That Not Be Nice,? peppered with shakers, funky bass notes and Daniel?s raspy vocals, sounds like another one of Spoon?s ragged and syncopated songs.
Only ?Neapolitans,? a tiptoeing, electro-rock haze written by Daniel, sounds like a step in a new direction, while ?Baby Gets Worse? feels like a true collaboration, as both vocalists add their pipes to the sproingy tune. ?My heart was beating in in and outta time / She can really get me gone,? sings Boeckner, who gets credit for writing the song.
Why the Handsome Furs are gone is still shrouded in darkness ? with fans speculating the worst. (Did Boeckner possibly break up with his wife, Alexei Perry?) If it?s any consolation, the defunct duo?s last album, Sound Kapital, is one of the 10 finalists for this year?s Polaris Music Prize, awarded Sept. 24 in Toronto.

There?s no lack of hip-hop heavyweights on Based on a T.R.U. Story, the debut album from 2 Chainz. If you want a snapshot of the album, just scan down to track eight: ?I Luv Dem Strippers (feat. Nicki Minaj).? Yes, it?s as trite as it sounds. There is a simple litmus test for enjoyment of this album. The fifth track, ?Birthday Song,? has a great beat and a solid verse from Kanye West. Take the lyrics out of the equation and there?s not much to dislike about it. But if the line ?all I want for my birthday is a big booty ho? makes you visibly cringe or triggers the reflex to reach for the ?remove disc? button then you might want to give this one a pass. I?ve listened to this album more than I expected to ? ?listenable? is about the highest accolade it deserves ? but we all have a line regarding insipid lyrics. If it doesn?t cross it, Based on a T.R.U. Story is bound to at least flirt with your line or, if 2 Chainz has his way, do much, much worse things to it.

Conventional wisdom holds that domestic contentment is the enemy of great songs. Important and resonant records, some say, come from conflict, internal or external.
There are those who say, however, that love songs are the backbone of all memorable popular music and wonder where this whole conflict rule comes from.
On her first album in four years, Alanis Morissette, two years married and the mother of one-year-old Ever, skirts the issue. Songs like the soaring synth-pop thank-you note ?Empathy? and the love ballad ?Til You? ? the latter written for her husband, rapper Mario ?MC Souleye? Treadway ? ooze with homebody happiness.
Others, like the percussive pop-cultural indictment ?Celebrity? and the psychedelic, Eastern-flavoured ?Lens,? which confronts religious and political conflict, keep a jaundiced eye on the world outside Morissette?s living room, where the album was recorded so she could have Ever nearby throughout the process.
Either way, however, Havoc and Bright Lights ultimately falls a bit short of delivering the great-songs part of the equation.
The first half offers the possibility that this might be a truly superior pop album. The opening track, ?Guardian,? shows Morissette easily retaining her crown as Queen of the Big Soaring Chorus. The sweet, bubbling keyboard backing in the verses collides with slicked-up ?Sweet Jane? guitar chords on the refrain, and it?s all just too hard to resist.
The winning combo illustrates the respective contributions of co-producers Guy Sigsworth, who brings the synth textures, and Joe Chiccarelli, who has worked with the Strokes and the White Stripes and knows his way around power chords.
While the next few songs keep the momentum going ? the lumbering beat of the anti-misogyny challenge ?Woman Down? recalls David Bowie?s ?Fashion,? and it really works ? the disc seems to run out of steam at about the halfway mark. By the time the unexceptional rockers ?Spiral? and ?Numb? turn up, the rush of harmonies that introduce the hooks have become ? as they always do ? an irritating formula. To make matters worse, the melodies fall by the wayside at about the same time.
?Edge of Evolution? closes the album with musings about the evolution of consciousness. Its main virtue is that it?s a shorter time investment than reading an Eckhart Tolle book. But as Morissette sings ?We?re ready to push envelopes into full-blown consciousness? in one of the album?s less memorable refrains, it?s only too clear that, musically at least, no envelopes have been pushed at all.

In a million years, was it really foreseeable that one of rock n? roll?s most unrepentant exhibitionists, self-mutilators and all-round garage-band icons would eventually record a faithful, irony-free version of the Beatles? ?Michelle?? Yes, the Ig has returned in crooner mode, following up his 2009 album of French chansons, Pr?liminaires, with a fairly similar late-night disc ? half of it in la langue de Moli?re, with Pop gleefully embracing the language and not rolling his ?r?s. In his deep bass rumble, the 65-year-old singer offers marvelous interpretations of classics written not only by the likes of Gainsbourg, Piaf and Brassens, but also by Yoko Ono, Nilsson and Cole Porter. At a concise 28 minutes, Apr?s takes its leave just as you?re getting comfortable, leaving you wanting much, much more.

Nick Cave and Warren Ellis ? colleagues in the Bad Seeds, Grinderman and soundtracking ? have specialized in scores saturated with dusty, desolate elegies (The Proposition; The Road; The Assassination of Jesse James by the Coward Robert Ford). The setting of Lawless (whose screenplay was written by Cave) ? Prohibition-era Virginia ? would seem to lend itself to the same treatment, but the soundtrack features a blue-chip singers? circle, mostly backed by Cave and Ellis? ad-hoc band, the Bootleggers. Vocalists and songs make repeat appearances: Mark Lanegan?s leather-bound baritone leads an irresistible hard-strumming cover of Link Wray?s country-blues barnburner ?Fire and Brimstone,? which is reprised in a very mortal performance by Ralph Stanley, whose craggy take on the Cave/Ellis composition ?Fire in the Blood? is contrasted with two serene readings of the same by Emmylou Harris. The recurring guests and material add to the cohesion of a soundtrack with a vibrant sense of time and place. By turns raucous and sombre, authentic and revisionist (the Velvet Underground?s ?White Light/White Heat? is convincingly transported to the 1930s by Stanley), the album hardly needs a film to justify its existence.

The Seer?s intensity could be measured by statistics alone: two hours in length, three songs that clock in at more than 19 minutes each. But numbers mean nothing when you?re confronted with the mind-altering zenith of Michael Gira?s obsession with transcendental tidal waves of sound. From ?Lunacy?s? witchy chant, to the exhilarating explosion and contraction of the 32-minute title track, to the infinite choral and cello drones dominating ?A Piece of the Sky,? to ?The Apostate?s? monumental raging groove, The Seer is uncompromising, towering, cathartic ? trance music that doesn?t pacify, but elates and exhausts. Rather than come off as stunt casting, the extensive guest list ? including former Swans vocalist Jarboe and Yeah Yeah Yeahs? Karen O (who sings the atypically tranquil ?Song for a Warrior?) ? reinforces the impression that while Gira will always be Swans? formidable conductor, this is the most collaborative work of his career.

Q: I have a signed offer on a condo for short sale. I am in the paperwork repetition cycle with my mortgage company as the mortgage was sold after the signed offer and all the paperwork was completed. We are in the process of redoing the paperwork and resubmitting the requested paperwork with the new mortgage company. The new mortgage company uses equator, which my realtor does not have/use. Therefore he gets someone else in his office to enter the data. This has proved to be laborious and inefficient. I have lost confidence in my realtors organizational, interpersonal and communication skills. Where does this leave me? I feel it would be counterproductive to make a switch at this time, but am having a hard time dealing with the realtors inability to answer questions, (which he can never answer and does not seem to understand) and his attitude. I doubt his knowledge base. What should I do?

A: Hello. I?m not sure but I am guessing you are the owner who is short selling; is that correct? If so then here are my answers:

Equator is free and required by several banks including Bank of America and Wells Fargo. There is no reason your agent couldn?t use Equator unless he does not have errors and omissions insurance; that is required.

I suspect he is not that educated in short sales. There are several extra certifications and designations that train agents in the short sale process. So I?m not sure why you chose this agent without any additional short sale credentials. Just because someone has a license does not mean they are fluent in short sales. In fact many agents never get those additional credentials and just add ?short sale expert? or ?short sale guru? or ?short sale professional? to their business cards or the advertisements. Those are nothing more than misleading, self-proclaimed gimmicks that agents use.

You should look for an agent who has SFR or CDPE after their name. They have earned those designations.

If you feel like firing your agent you should have an attorney review your agreement to keep you out of trouble.

A: You presumably have a signed listing agreement with the Broker. In most instances you have contracted with the Broker via the Realtor. These listing agreements can be hard to cancel. Call the Broker and state your case, ask to be re-assigned to his/her most knowledgeable Realtor who is familiar with short sales. After all, someone in the office is helping your Realtor. Who is that person? That may be who you want. He should be willing to comply after which he should smartly better train your Realtor.

Byrd Theatre faces $5 million lawsuit - NBC12.com - Richmond, VA ...

RICHMOND, VA (WWBT) -

Carytown's historic Byrd Theatre goes to trial tomorrow, faced with a $5 million lawsuit. An organ repairman sued the theatre after an accident that he says left him blind in one eye.

The famous Wurlitzer organ was installed in the Byrd Theatre in 1928 to accompany silent movies and still entertains moviegoers today.

While the Byrd Theatre Foundation has been working to raise its goal of $5 million to restore the aging theatre, it's been slapped with a $5 million lawsuit.

The suit claims that in May 2009, the Foundation invited David Barnett, of the Organ Historical Society, to repair the Wurlitzer as an unpaid volunteer. The suit alleges that Barnett lost his footing on a loose floor plank and hit his head, resulting in permanent blindness in his right eye, a fractured nose, and scarring.

NBC 12 legal analyst Steven Benjamin, who is not involved in the case, says it could come down to Barnett's status as an invited person to the theatre, and whether anyone knew that plank might be loose.

Said Benjamin, "The question will be whether this was an open and obvious danger and he should have used his own care to avoid it or whether it was a hidden danger and one that was known to the theatre. In which case they have a duty to warn him of that danger."

Neither Barnett nor the Theatre Foundation are commenting on the suit. The Foundation's attorney only told us they think the world of David Barnett, but are not responsible for his injuries.

Since a thief stole the Byrd Cage donation box in 2010, the Foundation has beefed up fundraising to restore the theatre, showing classic films and a screening of Judd Nelson's unreleased film shot at the Jefferson, "Rock N Roll Hotel."

Now, whether this lawsuit will impact the Byrd's future, or a man's future, will play out, not on screen, but in court.

Said Benjamin, "Ultimately that is left up to a jury. So if a jury feels that the defendant in this case was negligent and the negligence caused the loss of sight in one eye, then the question is for the jury, 'what is that worth?'"

The trial is scheduled to run Tuesday through Thursday in Richmond Circuit Court.
